A federal judge on Wednesday grilled the DOJ during a hearing in Comey’s case and questioned whether US Attorney Lindsey Halligan is a “puppet” for President Trump.
Judge Nachmanoff, a Biden appointee, questioned Halligan during a hearing on James Comey’s move to dismiss the federal criminal indictment.
A grand jury in the Eastern District of Virginia indicted former FBI Director James Comey in September. He was indicted on two counts – false statements and obstruction of a congressional proceeding.
Halligan originally presented the grand jury with a three-count indictment; however, the jurors rejected one of the charges against Comey.
Prosecutors then edited the charges, and the grand jury voted on the two-count indictment.
Halligan removed the charge and signed off on the two-count indictment. She told the judge that the grand jury was not presented with the new indictments.
Prosecutor Tyler Lemons told the Court on Wednesday that the final indictments were identical to the indictments already approved by the grand jury.
Comey’s lawyer argued that Halligan’s admission means there is “no indictment” against Comey.
Judge Nachmanoff asked Comey’s lawyer, Michael Dreeben if Halligan is a “puppet’ or a “stalking horse” for Trump.
According to Fox News, Dreeben said Halligan is likely operating at the direction of Trump.
“Dreeben responded that he would not use those words but that his team believed Halligan was operating at the direction of Trump, rather than independently. Dreeben said Trump had a years-long vendetta against Comey, who has been a vocal opponent of Trump since the president fired him from the FBI in 2017,” Fox News reported.
The judge did not issue a ruling on Wednesday.
Fox News reported:
A federal judge grilled the Department of Justice Wednesday about whether it mishandled the grand jury indictment against former FBI Director James Comey and asked if interim U.S. Attorney Lindsey Halligan, who is leading the case, acted at the behest of President Donald Trump.
Judge Michael Nachmanoff found during the hearing in Alexandria, Virginia, that Halligan signed an indictment alleging two charges against Comey but that that document was never presented to the full grand jury, a revelation that could imperil the case if Nachmanoff decides it is enough to delegitimize the indictment.
Nachmanoff directed Halligan, who had no prosecutorial experience before Trump installed her to lead the Eastern District of Virginia in September, to come to the stand, giving her the chance to speak for the first time in the courtroom since her appointment.
