The DC Circuit Court of Appeals on Wednesday evening said the Trump Administration could not appeal an administrative stay entered by corrupt Obama Judge Amy Berman Jackson.
Another Biden holdover in the Executive Branch caught up in President Trump’s firing spree filed a lawsuit to get his job back – and a corrupt Obama judge sided with him earlier this week.
As previously reported, President Trump fired Hampton Dellinger, Special Counsel of the Office of Special Counsel (not to be confused with a special counsel hired as a federal prosecutor) on Friday.
“On behalf of President Donald J. Trump, I am writing to inform you that your position as Special Counsel of the US Office of Special Counsel is terminated, effective immediately. Thank you for your service,” Sergio Gor, Director of the White House Presidential Office wrote to Hampton Dellinger, according to Politico.
Trump immediately appointed Veterans Affair Secretary Doug Collins to take over Dellinger’s job as the Special Counsel.
The lawsuit and Temporary Restraining Order request was assigned to corrupt Obama judge Amy Berman Jackson.
On Monday evening, Judge Amy Berman Jackson sided with Hampton Dellinger and issued an administrative stay and allowed him to keep his job.
“Trump must allow Dellinger to continue to have “access” to the agency’s resources and cannot “recognize the authority of any other person as Special Counsel” while the order remains in effect, Jackson wrote,” according to Politico.
“I am grateful to have the opportunity to continue leading the Office of Special Counsel and I am resuming my work tonight,” Dellinger said in a statement, Politico reported.
Amy Berman Jackson entered an administrative stay rather than a TRO which made appealing her decision tricky.
The Trump Justice Department immediately appealed Judge Jackson’s administrative stay anyway on Monday night.
The DC District Circuit Court of Appeals on Wednesday dismissed Trump’s appeal of Judge Jackson’s administrative stay and kicked Dellinger’s firing back to Amy Berman Jackson.
The three judge panel – Florence Pan (Biden), Michelle Childs (Obama) and Greg Katsas (Trump) said the Trump Administration cannot appeal an ‘administrative stay.’
“…the emergency motion for stay be dismissed as moot,” the judges said in Wednesday evening’s order.
Judge Jackson’s order expires on Thursday.

Trump will have to go to the Supreme Court or wait for the judge to issue a Temporary Restraining Order (TRO) in order to appeal.
